Rebuilding a contractor's programme mid-project

The challenge

The situation

A contractor part-way through a job was still insured on the scope it had tendered on. Variations had since added deep excavation near a neighbouring boundary and a longer maintenance period, plant on site was leased rather than owned, and the employer's contract required liability limits and waiver wording the existing policy did not carry.

What we did

We read the contract's insurance clause against the policy and set out the differences in writing. The revised scope went back to the market, the sum insured basis was corrected, the maintenance period was extended to match the contract, and leased plant was scheduled with the lessor's interest noted. Third-party liability was rearranged on terms the employer would accept, and an existing crack in a neighbouring wall was notified as a circumstance before it could be argued as late.
